Robot Rewards Program Terms and Conditions

These Program Terms and Conditions contain the terms and conditions that govern your participation in the Robot Rewards Program and is an agreement between Blonde Robot

Australia (ABN 87 143 295 247).

Definition of Terms:

Blonde Robot Customer means a customer of Blonde Robot:

(a) who currently holds a direct trading account with Blonde Robot Australia;

(b) the place of business of which is located in Australia or New Zealand; and

(c) that purchases Blonde Robot products and services.

Blonde Robot Rewards Program Website ​means www.robotrewards.com.au or such other website advised by Blonde Robot from time to time;

Campaign Period​ means the period identified in the Incentive Campaign, during which period Eligible Sales may be used to earn Rewards.

Eligible Sale​ means a sale by you of an Eligible Product that has been accepted by Blonde Robot and has not been cancelled as at the expiry of the Campaign Period.

Incentive Campaign​ means a campaign which allows you to earn Rewards from Eligible Sales, details of which are set out in your Account.

Program Terms​ means the terms and conditions set out in this document.

Reward ​means a reward for achieving a sales goal (for example, Blonde Robot products or gift vouchers) as specified in the Incentive Campaign.

Rewards Account ​means the account page for your profile which is located on the Blonde Robot Rewards Program Web

This Agreement takes effect when you visit the Robot Rewards Program

Website https://www.robotrewards.com.au.

By using the Blonde Robot Rewards Website you agree to the terms and conditions outlined below. If you do not agree with the terms and conditions outlined below, you are ineligible to use the Robot Rewards Program Website.

The Promotional Period:

1. ​Promotional Period for the program is:

(a) Promotional period commences: 4 February 2019.

(b) Promotional period concludes: 4 February 2020.

(c) Claims must be received by: 4 February 2020.

2. ​Eligible Products

(a) Eligible products are Blonde Robot products that Blonde Robot determines earn points for sales by its retail partners during the promotional period.

(b) Eligible products for the promotion can be found within the Robot Rewards website.

3. ​Participating in the Program

(a) The Program is a trade promotion. Blonde Robot reserves the right to modify, cancel or terminate any or all elements of the Program at any time, subject to these terms and conditions.

(b) You may participate in the Program if you are an Australian or New Zealand resident and you are employed by a Blonde Robot Reseller, for the purposes of selling Blonde Robot products at the time of claiming your reward.

(c) To participate in the program, you must register as a program participant at www.blonde-robot.com.au and use the portal to participate in the program. Claims will not be accepted by post or e-mail.

4. ​Your responsibilities

You must:

(a) comply with all rules, regulations, employment contractual limitations, and/or official policies of your employer, if any, regarding your participation in the Program; and

(b) maintain the confidentiality of your login information (user ID and password).

5. ​The Incentive Campaign

(a) The Program entitles you to earn Rewards by making Eligible Sales as outlined in a relevant Incentive Campaign. Details of the Incentive Campaigns for your organisation, including any specific terms and conditions, will be set out by your Blonde Robot account manager and be available to view online on your Blonde Robot Rewards Account.

(b) You may access your Rewards Account by using your login information which is provided to you via e-mail upon approval of your registration.

(c) We may vary an Incentive Campaign at any time by posting the revised Incentive Campaign to your Rewards Account. Any change to an Incentive Campaign will take effect upon posting to your Account. By visiting your Rewards Account or participating in the Rewards Program after any change takes effect, you agree to the latest version of the Incentive Campaign.

6. ​Earning Rewards

(a) To claim Eligible Sales, you must enter a claim into the Blonde Robot Rewards website within 30 days of sale and upload a copy of the sales docket to validate your sale as being eligible.

(b) All claims entered into the Blonde Robot Rewards system will be reviewed by Blonde Robot Australia for verification of validity and once approved the points will transfer to your Blonde Robot Rewards account.

(c) Only one person from your organisation may claim a particular Eligible Sale. Claims are not transferable to any other person.

(d) Eligible sales are to be claimed by the individual who made the sale not pooled together as a store.

(e) Approval of the claims is solely at the discretion of Blonde Robot and claims may not be validated if the sales deemed to breech agreed trading terms between Blonde Robot and the retailer, or any part of this document.

(f) Rewards claims of volume quantity sales made to (but limited to) government departments and corporate business, wholesales or trade accounts will not be deemed as a valid sale resulting in the points not being awarded to the claimant.

(g) Rewards claims of sales to foreign entities and/or businesses outside Australia, New Zealand and the Pacific Islands will not be deemed as a valid sale resulting in the points not being awarded to the claimant.

(h) Blonde Robot may rely solely on its own records in determining whether you are entitled to a Reward and you agree that Blonde Robot determination is final.

(i) Claims may be subject to an audit if discrepancies are found (i.e. retailer sell through report lower than total claims made by registered program participants).

7. ​Rewards

(a) Rewards can only be claimed once the required points have been reached for the desired reward e.g. If the reward item costs 1,500 points and you only have 500 points, redemption of the reward can only occur once you have accrued 1,500 points.

(b) Products that can be claimed as rewards are set out in schedule 2.

(c) You acknowledge and agree that Rewards may be subject to additional terms and conditions which will apply between you and the Reward provider. For example, if you earn a voucher as a Reward, the voucher will be subject to additional terms and conditions imposed on you by the voucher provider.

(d) Rewards are non-transferable and are not redeemable for cash.

(e) If the redeemed item is in high demand priority for allocation will be given to trade sales accounts over rewards fulfilment. Thus a delay in fulfilment may be experienced for high demand items.

(e) Blonde Robot accepts no responsibility for any tax implications (including any fringe benefits tax) that may arise from any Reward. You are responsible for obtaining independent financial advice in relation to any Rewards earned by you.

(f) Any rewards that are redeemed from Blonde Robot can only be used for personal use and not re-sold by a commercial entity. Should Blonde Robot be made aware that redeemed rewards are being re-sold by a commercial entity either directly or via an auction house Blonde Robot reserves the right to execute recovery activity and suspend the rewards account.

(g) Any rewards that are redeemed from Blonde Robot will be serial number tracked and should not be resold for personal gain via online auction sites or classifieds lists (i.e. eBay, Gumtree or Trade me etc.) within 6 months of receiving the prize.

8. ​Termination

8.1 ​Termination of your participation

(a) You may terminate your participation in the Program at any time with immediate effect by email to rewards@blonde-robot.com.au

(b) We may terminate your participation in the Program at any time with immediate effect if your employment terminates or your employer ceases to be a Blonde Robot Customer.

(c) We may terminate your participation in the Program at any time with immediate effect if we suspect that you:

(i) are in breach of these terms and conditions; or

(ii) have engaged in fraudulent or unlawful activities or misleading and deceptive conduct.

8.2 ​Termination of the Program or any Incentive Campaign

(a) We may terminate or suspend the Program or any Incentive Campaign at any time for any reason. Notice of any termination or suspension of:

(i) the Program will be posted to the Blonde Robot Rewards Program Website;

(ii) any relevant Incentive Campaign will be posted to your Rewards Account, and will be effective from the time of posting (Notice of Cancellation).

(b) If we terminate the Program or an Incentive Campaign we may, at our discretion, allow you to submit any outstanding claims for Eligible Sales (Eligible Sales must be completed as of the date of Notice of Cancellation) for 30 days from the date of Notice of Cancellation.

9. ​Warranties

(a) To the extent permitted by law, we exclude all statutory or implied conditions or warranties (whether express or implied) with regard to the Program or any Reward.

(b) If any warranties or conditions are implied in respect of services provided under these terms and conditions or in connection with a Reward, then our liability for a breach of such warranty will be limited to the supplying of the services again or the payment of the cost of having the services supplied again.

10. ​Limitation of Liability

To the extent permitted by law, we are not liable to you in contract, tort (including negligence) or otherwise, for any direct or indirect loss or damage (including personal injury or death) suffered or incurred by you arising out of the Program or as a result of receiving, redeeming or using any Reward, including the delivery, acceptance, possession, use or misuse of any Reward, participation in the Program or participation in any Program or Reward related activity.

11. ​Making changes to the Program Terms

We may vary these Program Terms by posting the revised Terms on the Blonde Robot Rewards Program Website. Any change to these Program Terms will take effect upon posting on the Website. By visiting the Website or continuing to participate in the Rewards Program after any change takes effect, you agree to the latest version of these Terms.

12. ​Privacy

All personal information collected by Blonde Robot will be used for administration of the Program and as permitted by Blonde Robot' privacy policy. Blonde Robot’ privacy policy is available at https://blonde-robot.com.au/privacy-policy and contains important information regarding the collection, use and disclosure of personal information by Blonde Robot Australia.

13. ​General

(a) If any provision of these terms and conditions is unlawful, void or unenforceable, that provision will be taken to be removed from these terms and conditions. However, the remaining provisions will continue to have full force and effect.

(b) These terms and conditions are governed by the law of New South Wales.

(c) A failure to exercise any right or remedy under these terms and conditions in a timely manner will not constitute acceptance of the matter which gave rise to the right or remedy, or a waiver of such right or remedy.
